While the standard route for securing permanent residence in Canada involves initiating the process from one’s home country, exceptions are possible under distinct scenarios. This specialized application is crafted for individuals currently in Canada, aiming to secure exemptions from Immigration and Refugee Protection Act (IRPA) requirements for a domestic permanent residence application.
This application is your fit if you:
- Reside in Canada and seek exemptions from specific IRPA requirements.
- Believe that your circumstances merit humanitarian and compassionate considerations, justifying required exemptions.
- Are ineligible to apply for permanent residence within Canada under specific classes, including Spouse or Common-Law Partner, Live-in Caregiver, Caregivers for children or those with high medical needs, Protected Person and Convention Refugees, and Temporary Resident Permit Holder.
Traditionally, foreign nationals aspiring to immigrate to Canada must obtain a permanent resident visa from their home country. However, under section A25(1) of the IRPA, foreign nationals facing inadmissibility or ineligibility in an immigration class can apply for permanent residence or an exemption based on humanitarian and compassionate (H&C) considerations.

3. Demonstrate sufficient and compelling reasons for being granted an exemption to apply for permanent residence from within Canada.
Factors such as the cost and inconvenience of returning to your home country, without other compelling factors, are insufficient for H&C considerations. Moreover, individuals are allowed only one H&C application under consideration at any time.
